In short
- Random is for adults (18+). One person, one account, with a phone number or email you control.
- Be decent. No harassment, no sexual content, no hate, no spam, no fake accounts, no sharing other people's private data. We enforce this with reports, human review within 24 hours, blocking, suspension and bans.
- You own what you post; you let us show it inside Random. Deleted or expired content is removed, with a 24-hour moderation copy.
- We only ever share your approximate area. We do not verify identities: be careful when you meet people in real life.
- The app is free, has no ads and nothing to buy. You can delete your account at any time.
This summary helps you read; the full text below is what binds.
1. Who we are and how to reach us
Random (the “Service”, the “App”) is provided by GEORGE FARCAS DESIGN S.R.L., a company incorporated in Romania, registered with the Trade Register under no. J12/4885/2021, tax identification number (CUI) 42245316, with its registered office at Str. Rodnei nr. 2, ap. 6, Cluj-Napoca, Cluj County, 400393, Romania (the “Company”, “we”, “us”). You can reach us at any time at hello@random-app.com and, inside the App, through Settings → Support and Feedback or the Safety chat. This information is published in accordance with Romanian Law no. 365/2002 on electronic commerce.
2. Acceptance and eligibility
2.1. These Terms of Service (the “Terms”) form a binding agreement between you and Random. By creating an account, ticking the box “I'm over 18 and I accept the Terms and the Privacy Policy”, or using the App in any way, you confirm that you have read, understood and accepted these Terms. If you do not agree, do not create an account and do not use the App.
2.2. You may use Random only if you are at least 18 years old, have full legal capacity to enter into this agreement, have not previously been banned from Random, and are not prohibited from using the Service under applicable law. We may remove without notice any account we reasonably believe belongs to a person under 18.
2.3. Random is offered to consumers. Nothing in these Terms limits rights that you cannot waive under Romanian law or the law of the EU country where you live.
3. Definitions
- Account — your registered profile, tied to a verified phone number or email address.
- Orb — the avatar you choose to represent you; Random uses no profile photographs.
- Thought — a short text or poll you publish on your profile, visible to people around you for the lifetime you choose.
- Request — the first message sent to another user, which that user may accept, ignore, delete or report.
- Place / Check-in — a venue near you that you may mark yourself as present at for a limited time.
- Trust Score — the average of the ratings other users give you after conversations, shown on your profile.
- Content — everything you or other users create or share through the Service: profile data, thoughts, polls, comments, messages, voice notes, photos, videos, stickers, ratings and check-ins.
- Community Rules — the rules in section 6.
4. The Service and your licence to use it
4.1. Random lets adults discover and talk to people around them through orbs, thoughts, places and chat. Some features (stickers and GIFs, voice messages, photos and videos, interest reveals, ratings) become available only after a certain number of messages have been exchanged in a conversation and after each participant approves them. We may change, add, suspend or withdraw any feature, and change thresholds and limits, at any time; where a change materially reduces the Service, we will inform you in the App or by the contact details on your Account.
4.2. Subject to these Terms, Random grants you a limited, non-exclusive, personal, non-transferable, revocable licence to install and use the App on an Apple-branded device that you own or control, solely for your own non-commercial use and only as permitted by these Terms, the Apple Media Services Terms and applicable law.
4.3. You may not: copy, modify, decompile, reverse-engineer or create derivative works of the App; rent, sell, sublicense or redistribute it; access the Service by automated means (bots, scrapers, scripts) or through any interface other than the App; circumvent security, rate limits, age checks or content restrictions; or use the Service to build a competing product.
4.4. The Service is provided free of charge. There are no advertisements and no paid features. If we ever introduce paid features, they will be governed by additional terms shown to you before any payment.
4.5. We are not obliged to provide maintenance, technical support or updates, although we will try to fix problems you report and to keep the App working with current iOS versions.
5. Your Account
5.1. One person, one account. You must register with a phone number or email address that you control, provide truthful information (including your gender and date of birth) and keep it up to date. You may not create an account for someone else, impersonate any person or entity, or use a username that is misleading, offensive or infringes someone's rights.
5.2. You are responsible for everything that happens under your Account and for keeping your device and verification codes secure. Tell us immediately at hello@random-app.com if you believe your Account has been accessed without your permission.
5.3. We may refuse, reclaim or change any username, including where it is inactive, infringes a right or breaches these Terms. Usernames may be changed at most once every 14 days.
5.4. Adding an email address or phone number in Settings is optional but recommended: it is the only way to recover your Account if you lose access to your original sign-in method.
6. Community Rules
Random exists for respectful, real conversations. We apply a zero-tolerance policy to objectionable content and abusive behaviour. You agree that you will not, and will not help anyone else to:
- harass, bully, threaten, intimidate, stalk or defame any person, or encourage others to do so;
- post or send sexual or pornographic content, nudity, sexual solicitation, or any content that sexualises anyone, including through text, stickers, voice, photos or videos;
- post or send content that is hateful or discriminatory on grounds such as race, ethnicity, nationality, religion, sex, gender identity, sexual orientation, disability, age or illness;
- post or send content depicting or promoting violence, self-harm, suicide, terrorism, weapons trafficking, drugs or other illegal activity;
- post or send any content involving minors in a sexual, harmful or exploitative context — such content is reported to the competent authorities;
- impersonate another person, use a fake identity, or misrepresent your age, gender or affiliation;
- collect, publish or share another person's personal data (name, phone, address, workplace, photos, precise location) without their consent, or attempt to identify, locate or track a user (“doxxing”);
- send spam, advertising, promotions, chain messages, phishing, scams, requests for money or cryptocurrency, or links to malicious content;
- use Random for prostitution, escort services, trafficking or any commercial sexual activity;
- manipulate ratings, Trust Scores, check-ins, crowns or polls, including by creating multiple accounts or coordinating with others;
- check in at a place where you are not physically present, or misuse Places to monitor other people;
- record, screenshot or redistribute other users' ephemeral content in order to harass, extort or expose them;
- infringe anyone's copyright, trademark, privacy, publicity or other rights;
- interfere with the Service, its servers or networks, probe or test vulnerabilities, or introduce malware.
Breaching a Community Rule is a material breach of these Terms and may lead to immediate removal of content, suspension or termination of your Account, and, where required, reporting to the authorities.
7. Content moderation: how it works
This section describes the policies, procedures, measures and tools we use to moderate Content, as required by Article 14 of Regulation (EU) 2022/2065 (Digital Services Act).
7.1. Tools built into the App
- Report — every profile, thought, message and request can be reported with a reason (Harassment or offensive language; Spam or scam; Inappropriate content; Fake profile / bot; Something else). Reports go to our Safety team.
- Block — blocking a user hides both of you from each other across the whole Service; the blocked user is not notified.
- Mute, Ghost Mode, deletion — you can silence a conversation, hide yourself completely from other users, and delete your own content or Account at any time.
- Automatic limits — technical rules limit message length and frequency, cap unanswered requests at 5 messages, expire ignored requests after 7 days and require both participants to approve richer features. These are rate and format limits, not automated judgements about the meaning of your Content.
- Age gate and terms acceptance at sign-up; the Community Rules are shown again before your first thought is published.
7.2. Human review
Reports are reviewed by people, not by algorithms. We aim to act on every report within 24 hours of receiving it. Decisions are taken diligently, objectively and proportionately, taking into account the context, the severity, whether the conduct is repeated, and the fundamental rights of everyone involved, including freedom of expression.
7.3. Reporting illegal content
Anyone, including people without an account, may notify us of Content they consider illegal by writing to hello@random-app.com with: an explanation of why the Content is illegal, where it is located (username and, if possible, a screenshot), your name and email address, and a statement that the notice is accurate and made in good faith. We confirm receipt and inform you of our decision.
7.4. Measures we may take
Depending on the case: removing or restricting Content; warning the user; limiting features; suspending the Account while a report is reviewed (the App shows a notice that the account is on hold); terminating the Account and refusing new registrations (“ban”); preserving evidence and cooperating with law enforcement. Serious cases, in particular anything involving minors, threats of violence or sexual exploitation, lead to immediate termination.
7.5. Statement of reasons and how to appeal
When we restrict or remove your Content or your Account, we tell you which rule or law was breached and what we did, except where a law prevents this or where telling you would put someone at risk. You may contest the decision within 6 months by replying in your Safety chat or by writing to hello@random-app.com. Appeals are examined by a person who did not take the original decision, and we answer with a reasoned decision. You may also use the out-of-court dispute options in section 19.
7.6. Retention of removed content
Content that you delete, or that expires, disappears from the Service immediately. A copy is kept in a restricted moderation store for 24 hours so that abuse reported after deletion can still be assessed, then it is permanently destroyed. Content that is the subject of an open report or a legal request may be preserved for as long as necessary to handle that report or request.
8. Your Content
8.1. You keep ownership of the Content you create. You grant Random a worldwide, non-exclusive, royalty-free, sublicensable (only to our service providers) licence to host, store, reproduce, adapt (for example to resize or compress), display and transmit your Content solely to operate, secure, moderate and improve the Service. This licence ends when your Content is deleted from the Service, except for the 24-hour moderation copy, for Content that other users have already received and for backups that are purged in the ordinary course.
8.2. You warrant that you have all rights needed to post your Content, that it is accurate where it presents facts, and that it complies with the Community Rules and the law.
8.3. Ephemeral content. Photos and videos you send can be viewed once or for a limited time and are then deleted from our servers and from the recipient's App. We cannot prevent a recipient from photographing a screen or using another device to capture content; the App notifies you when a screenshot is taken, but you send such content at your own risk.
8.4. Polls. The author of a poll can see who voted for each option; the App tells you this before you vote.
8.5. We do not pre-screen Content and we do not endorse it. Other users' Content reflects their views, not ours. We may remove or refuse any Content for any reason consistent with section 7.
8.6. If you send us ideas or feedback about Random, we may use them without any obligation to you.
9. Location, Places and meeting people
9.1. With your permission, the App uses your device's location to show people and places around you. What other users see is only your approximate area (rounded to about one kilometre, and, on the map, deliberately offset by 1–3 km) and the place you have checked in at. You can withdraw the permission at any time in iOS Settings; the App keeps working without it.
9.2. Check-ins must be honest and are limited to one place at a time for up to three hours. Places, their names, categories and opening hours come from third-party map data and may be inaccurate or out of date.
9.3. Random does not verify the identity, age, background or intentions of its users. We do not run criminal-record checks. Anyone you talk to, and anyone who says they are at a place, may not be who they claim. You are solely responsible for your interactions with other users, online and in person. Use common sense: meet in public places, tell someone where you are going, never send money, and report anything that feels wrong. We are not responsible for the conduct of any user, online or offline.
10. Trust Score and ratings
After a conversation reaches a certain length, each participant may rate it once on a scale of 1 to 5. Ratings are anonymous to the rated person and are combined into a Trust Score. Ratings must reflect a real conversation and your honest opinion. Coordinated, retaliatory or fake ratings, or ratings between accounts controlled by the same person, breach these Terms and may be removed together with the accounts involved. Ratings of places must reflect a real visit.
11. Notifications and communications
With your permission we send push notifications about messages, requests, reactions, interest reveals, followed users' thoughts, safety decisions and, occasionally, important announcements from the official @random account. Notifications never contain message content. You can switch them off at any time in iOS Settings. We may also contact you by email or phone number about your Account, security or changes to these Terms.
12. Privacy
How we collect and use personal data is described in our Privacy Policy, which forms part of these Terms. In short: your contact data, notification token, block lists and exact coordinates are private to you and our servers; other users see only your public profile and approximate area; we do not sell data and do not use it for advertising.
13. Third-party services and Apple
13.1. The App uses services of third parties, in particular Google Firebase (authentication, database, storage, notifications, analytics, crash reporting), Mapbox (maps) and Giphy (GIF search). Your use of those features is also subject to their terms, and you agree to comply with any applicable third-party terms when using the App.
13.2. Provisions required by Apple. These Terms are concluded between you and Random only, not with Apple Inc. or its subsidiaries (“Apple”). Apple is not responsible for the App or its content. Apple has no obligation to provide maintenance or support for the App. In the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) to you; to the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App. Random, not Apple, is responsible for addressing any claims by you or any third party relating to the App or your use of it, including product liability claims, claims that the App fails to conform to any legal or regulatory requirement, and claims under consumer protection or similar legislation. If a third party claims that the App infringes its intellectual property rights, Random, not Apple, is responsible for investigating, defending, settling and discharging that claim. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a “terrorist supporting” country and that you are not on any U.S. Government list of prohibited or restricted parties. Apple and Apple's subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, may enforce them against you.
14. Intellectual property
The App, its design, code, orbs, icons, sounds, texts, trademarks (including “Random” and the R logo) and all related rights belong to Random or its licensors and are protected by Romanian, EU and international law. Except for the licence in section 4.2 and your own Content, no rights are granted to you. You may not use our trademarks without our written permission.
15. Termination
15.1. By you. You may stop using the Service and delete your Account at any time from Settings → Delete My Account. Deletion permanently removes your profile, thoughts, messages, check-ins and ratings, subject to section 7.6 and to data we must keep by law.
15.2. By us. We may suspend or terminate your Account, with or without notice, if you breach these Terms or the Community Rules, if we are required to by law or by a court or authority, if your Account has been inactive for more than 24 months, or if we discontinue the Service. Where reasonably possible we will tell you the reason and how to appeal (section 7.5). We may keep records necessary to enforce a ban.
15.3. Sections that by their nature should survive (in particular 6, 7.6, 8, 13–19) survive termination.
16. Warranties and liability
16.1. The Service is provided “as is” and “as available”. To the extent permitted by law, we make no warranty, express or implied, that the Service will be uninterrupted, error-free, secure, or that any Content, map data, opening hours, distance or Trust Score will be accurate, or that you will meet anyone or achieve any particular result.
16.2. Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for intent or gross negligence, for fraud, or for any liability that cannot be excluded under Romanian law or the mandatory consumer law of the country where you live.
16.3. Subject to 16.2, we are not liable for: the conduct, Content or identity of other users, online or offline; loss, corruption or unauthorised capture of Content, including screenshots of ephemeral content; unavailability caused by events beyond our reasonable control; indirect or consequential loss, loss of data, or loss of profits, business or reputation.
16.4. Subject to 16.2, and because the Service is free, our total liability for all claims arising out of or relating to the Service in any 12-month period is limited to EUR 100. This cap does not apply to consumers to the extent that the applicable law does not allow it.
17. Your responsibility to us
To the extent permitted by law, you will compensate Random for losses, costs and reasonable legal fees arising from claims by third parties caused by your Content, your breach of these Terms or your violation of any law or third-party right. This does not apply where the claim results from our own fault.
18. Changes to these Terms
We may update these Terms to reflect changes in the Service, the law or our practices. We will post the new version here with a new effective date and, for significant changes, inform you in the App or by email at least 15 days before they take effect. If you do not agree with a change, delete your Account before the effective date; continued use afterwards means acceptance. The current version is always available at random-app.com/terms and in Settings.
19. Governing law and disputes
19.1. These Terms are governed by the laws of Romania, without prejudice to mandatory consumer protection rules of the EU country in which you habitually reside.
19.2. If you have a complaint, please contact us first at hello@random-app.com; most issues are solved quickly. Consumers in Romania may also address the National Authority for Consumer Protection (ANPC, anpc.ro) and may use the alternative dispute resolution (SAL) entities listed by ANPC. Consumers in other EU countries may use the equivalent bodies in their country.
19.3. Any dispute not resolved amicably is submitted to the competent courts of Cluj-Napoca, Romania, except that consumers may also bring proceedings before the courts of their own place of residence where the law so provides.
20. General
- Entire agreement. These Terms, the Privacy Policy and the Community Rules are the entire agreement between you and Random about the Service.
- Severability. If any provision is found invalid, the rest remains in force and the invalid provision is replaced by a valid one closest to its intent.
- No waiver. Our failure to enforce a provision is not a waiver of it.
- Assignment. You may not transfer these Terms. We may transfer them to a successor of our business with notice to you.
- Language. These Terms exist in English and Romanian. For consumers residing in Romania the Romanian version prevails; otherwise the English version prevails.
- Force majeure. Neither party is liable for delays or failures caused by events beyond its reasonable control.
